The importance of private property lies in his symbology as one of the first human rights. Thus, a broad definition of the concept of private property involves, in effect, the undisputed right of natural or legal persons to purchase for lawful means, preserve, control, dispose of, and leave real property as an inheritance to other individuals (movable objects, financial capital, land, real estate, or others).
Throughout history, it has been differentiated private property of the so-called “public property” as a counterpart, in reference to the goods administered directly by the State (federal, regional or municipal), the community or the government, without concrete action on the part of individuals or companies.
The repercussion of concept of private property has motivated the creation of different economic models, in which this idea is pondered or eliminated to give rise to the construction of a system. On the one hand, capitalism constitutes a model in which private property represents the cornerstone, given that the investments of those goods would motivate the creation of sources of work, at the same time that revenue is obtained from the start-up of the aforementioned estate. The system arose as opposition to the despotisms of the old monarchies and has been accompanied by the appearance of numerous accompanying rights, enshrined in the
Constitution of different nations and in many of the fundamental laws of most Western nations. As an antithesis, the Marxist model is described, in which private property is considered as an obstacle to the material growth of society, which is why they fight for their elimination with the transfer of all the assets to the scope of the administration of the State. Although it has been characterized by different nuances, this system has not been effective in the different nations where it was applied.
On the other hand, the private property it has been associated with other individual liberties, such as the possibility to trade, learn, teach, move around the national territory and exercise freedom of religion. Therefore, it is difficult to detach the concept of private property from the definition of democracy or a republican structure of government.
