Example of a Judicial Request for Child Custody

The court application for child custody, is a document in which a relative, either the father or the mother respectively, or where appropriate the hierarchical superior (grandparents, uncles, etc.), request custody of the minors because the person who takes care of them or has the power, does not comply with the obligations or in particular, that it is considered harmful to the minors themselves and their careful.
This document is presented directly to the authority that has attention to the corresponding matter, and in In the event that it does not exist, it would be directed to the MP agent, who would be in charge of the formalities corresponding.

Who subscribes Benito Pérez Bodoque with address at Rio Lindo No 324 Col. New Lake, Municipality of Popotla State of Mexico, I am writing to you in order to request in my own right the custody of my minor children; who have their domicile as established in article 2.20 of the Civil Code in its fifth title.
Considering that it is healthier and more convenient for my minor children, I make this request to you, C Judge to grant me the custody of my three minor children, names (put the names of the kids); this as established in article 4.203 of the civil code of the state of Mexico.
Knowing how the circumstances can be presented, based on Article 4.205, I ask you to rule in my favor, granting custody and custody in my favor.
I clarify that the cause of my request is due to the fact that the father of my minor children is not giving the corresponding treatment to them.
And for the same reason I ask you to exercise the power that is indicated in Article 4,228, especially what is established in Subparagraph “I” section “a)”, which states:
"... a) Children under the age of ten will be in the care of the mother, unless it is detrimental to the minor; ..."
And being obviously clear that it is not harmful, I demand that you accept this premise. And in case there is a refusal on the part of the father of my daughters, I ask that you extend your powers granted by the same article of the civil code.
For the above.
I ask:
First.- That I be considered, as presented in a timely manner, and in accordance with my right and that of my minor children.
Second.- Take the necessary precautionary measures.
Third.- Grant what corresponds to my request, dictating your resolution in my favor.
