A hope sale contract, is a contract in which one of the parties, which is called "THE SELLER" agrees to sell the product of their work, which can be from a planting, a litter of animals or even a particular production and deliver it to the counterpart called "THE BUYER".

I was told by the appearing parties that occur before me to enter into a Hope Purchase contract that they formalize in accordance with the following statements and clauses:
STATEMENTS:
First.- THE SELLER declares that she is the legitimate owner of the property known as "RANCHO MIRAFLOR" which is located in the jurisdiction of the municipality of Amealco de Bonfil, the which has an area of 250 hectares adjacent to the south with the ranch "El Jíbaro", to the north with the federal highway México Querétaro at kilometer 2365 to the originating border with Lake Chipitin and to the west with another farm called “El Condor”. “THE SELLER” declares that said property was acquired by testamentary succession of her deceased husband, who He acquired it in 1983 from Mr. Jacinto Flores Juárez, a purchase that is verified by public deed dated December 11, 1983, executed before the notary public number 3687 Lic. He declares that the property and all crops and livestock that are found, are aware of any existing encumbrances existing certificates corresponding to the payment of the property tax, for which a certificate of freedom from encumbrances was issued, which was issued by C. In full knowledge and attentive to the above statements, both parties "THE SELLER" and "THE BUYER" agree to enter into this contract for the sale of hope, subject to the following :
CLAUSES:
I. "THE SELLER" Is obliged by this contract to transfer the ownership of all the furos that can be extracted from the 90 hectares of vine, which are declared above in the declaration Second to "THE BUYER" which will be paid at a price of 8000.00 (eight thousand pesos M / N) per hectare, leaving a total of 720,000.00 (seven hundred twenty thousand pesos M / N).
II. "THE BUYER" undertakes to pay what is established in the previous clause (I) as the price of the products found in the 90 hectares of vineyards. Being fully clear, that the loss for whatever reason of the harvest is at the risk of the buyer, whether it is partial or total loss, leaving exempt "THE SELLER" from all responsibility or return of the agreed price, this in accordance with article 2117 of the Civil Code in force in the state of Queretaro.
III. "THE SELLER" Is obliged to water and maintain the fruit plants as necessary so that the necessary conditions for the harvest can be obtained.
IV. All collection and transportation expenses will be borne by "THE BUYER".
V. Both parties agree to pay the expenses related to this hope sale contract in equal halves.
