The Right of petition is part of some of the constitutional guarantees within the framework of a constitution or Constitution. This guarantee allows people to ask a question or request to a state agency and wait for a prompt response on it.
In some countries it is considered that any action that a person develops before the public administration it must be considered as a right to petition. This particularity is relevant, since it implies that it is no longer necessary to invoke the explicit right of petition for it to be recognized as such. It should also be noted that not all requests have the same rank, since in the legislation petitions are usually considered with priority attention in cases of urgency.
Types of right to petition
The regulation of the right to petition is developed through a law specific. The right to petition has three possible variants: request for information, complaints and claims and inquiries. Each of them has a certain number of days for the citizen Obtain a concrete response from the body receiving the request.
If we attend to the purpose of the right to petition, it can be of general interest (a group that files a complaint) or of particular interest (a citizen who makes a query).
Filing a petition
As for the administrative mechanism, the most common is to present a copy to the body to which the petition is addressed and another copy to the interested party as proof of the question raised. It is necessary to indicate in the heading of the letter to whom it is addressed, that is, the authority which should give an answer. On the other hand, the subject should be specified in the heading as briefly and precisely as possible.
As well as the personal data of whoever interposes the right of petition. The request for the letter must indicate what is requested (for example, I request a copy of my medical record or a certificate of studies).
It is convenient to support or support the request in some motivation specific (for example, if someone needs to be operated on, it makes sense to request a medical record). It may be necessary to accompany the request with some additional information or evidence that justifies the request itself. To conclude the request, it is convenient to indicate that a response to it and some form of dismissal are expected, as well as the personal signature at the end of the document.
A technical singularity of the right to petition in recent years is the possibility of submitting an online petition with full validity administrative.
