Hosting Contract Example

A hosting contract, is a contract that formalizes the use of a room, apartment, or room in general, and is entered into between the transferor or operator of a hotel, motel, hostel, guest house or pension and an individual who requires the use of said bedroom.
The landlord is generally referred to as a "Hostelero" and the landlord as a "Guest".

LODGING CONTRACT
Accommodation contract entered into as landlord by Mr. Camilo Rodríguez Pérez and as landlord by Mr. Eduardo Morales Mora, who from now on will be known as "Hostelero" and "Guest" respectively; both are of legal age and with full legal capacity to contract and be bound and contract; the parties agree to be bound by the following clauses:
CLAUSES:
First.- The “Hostelero” will give the “Guest” the apartment that is marked with the number 16 of the building called "El Dandi" which is located on Albatros street, number 563, industrial colony, Of. Iztapalapa, Mexico Federal District.
Second.- The room is made up of a bedroom, a bathroom, a living room, and a balcony; It is properly furnished, in perfect conditions of use, hygiene and health.
Third.- The "Guest" accepts said apartment, and confirms that it is in the conditions indicated in the Second Clause.
Quarter.- The "Hostelero" is obliged to manage the cleaning of said apartment, provide food in the general dining room of the building and said meals will be carried out according to a schedule that will be previously indicated:
Fifth.- Meal hours and use of the laundry: these two services will be regulated as follows:
- Breakfast will be served at 7:00 am, and will be varied during the week, if there is a specific medical diet, it must be explained one day in advance.
- Food will be served at 3:00 p.m. and will vary during the week, if there is a specific medical diet, it must be explained one day in advance.
Sixth.- Payment will be made in advance and will be for a total of $ 3,600.00 60/100 M / N (Three thousand six hundred pesos national currency) to be paid on the 13th of each month.
Seventh.- The accommodation referred to in this contract will begin on August 13, 2012, and will end on April 13, 2013.
Eighth.- The hotelier is obliged to carry out the necessary repairs that do not involve damage caused by the "Guest".
Ninth.- The "Guest" will carry out, or pay for, the repairs caused by him, or the improvements that he considers necessary, which must be carried out, prior notice and consent of the "Hostelero".
Tenth.- It is the obligation of the "Hostelero":
- Not to block in any way, the use of the apartment; taking as an exception only the repairs that are urgent and indispensable.
- Guarantee the use of said apartment, during the period agreed in the contract.
- Respond for the damages caused to the "Guest" due to non-visible defects of the apartment that are subsequent to the signing of the contract.
- Give an account and answer for the damages that may occur in the event of eviction of all or part of the apartment.
- Issue the corresponding receipts for the payment of the corresponding rent agreed upon in this contract.
- Both parties undertake to comply with all other obligations that the Civil Code imposes on the parties both to the hotelier and to the Guest.
Eleventh.- The obligations of the "Héesped" are:
- Fully pay the remuneration stipulated in this contract.
- Use the apartment given in lodging only for house-room;
- Do not grant the use of the same, in whole or in part, to another and other people;
- Do not make changes to it without the prior written consent of the hotelier;
- Notify the hotelier of any damage that may arise, and he will be responsible for the damages that the omission of it causes.
- Keep the apartment in the good condition in which it was received, and return it in that same condition at the end of the contract;
- Receive food at the time previously set by the manager of the dining room; complying with all the obligations that the Civil Code imposes on the guests.
Twelfth.- The water, drainage, electricity and gas services will be paid by the hotelier, and the corresponding aliquot will be applied to the cost of the room.
This contract will be signed in original and a copy, as well as there must be a witness for each of the parties who will attest to it.
