As with many areas, the right is a space where we can find endless very specific and particular terms that are used in also specific situations and that are not usually heard or used outside the scope professional. Among those words we find that of certiorari. Certification refers to a possible action or prerogative through which a particular case or event can be transferred or passed from one body to another in order to find a solution more efficient and coordinated.
Certification is a very typical phenomenon or condition of administrative law. In this sense, it is common for certiorari to be given, for example, within the same institution to get answers about something that could be stopped without resolution. It is also important to note that certiorari is very common in bodies and institutes of the public administration.
When we witness an act of certiorari, we are talking about a legal, administrative or legal body deciding to take over a matter, a case or example in order to resolve it. This is given from the
observation and / or verification that the matter or case in question does not advance in its resolution. The decision to take a case that until now was under responsibility of a smaller body is always the decision of the body or section that takes the case and that must also always be superior to the one that owned it before. This is so because it is assumed that by going to a higher body, the issue or problem can be resolved more effectively.This situation of transfer of issues or problems is very common in the field of law and the judicial system. However, it is only when we talk about certiorari that we are talking about specific and particular cases rather than about issues or problems. since, as said before, the phenomenon of certiorari occurs when slowness, inexperience or inability to solve a problem is observed question. When the term is used outside the scope of law, it will always refer to the passage of a topic or conflict at the hands of a superior in the scale hierarchical in order for it to be resolved.
