In the field ofrightundoubtedly the most popular reference, the trial consists of a legal discussion between the intervening parties and whose dissemination and resolution is submitted to the knowledge of a judge or court, specially trained to resolve the matter.
In other words, in a trial, basically, a conflict between parties with conflicting interests.
Each party will be represented by a lawyer who will have the mission of ensuring that the position of his client is recognized over that of the other party.
Meanwhile, the judge or court is the one who has the power to define which of the two parties is the one within the law or rule.
Once you listen to each party, the witnesses, and appreciate the evidence, you will pass judgment.
The trial is one of the oldest procedures in the matter of
administration of justice in a community and that has remained in force over time. The human being, always, has been busy and concerned about the matter of justice, in seeking it precisely when the situation so demand and this led to the creation of this type of mechanisms that a priori guarantee the administration of justice when there is a illicit.
The need for justice has always been present, but of course, today's society is not the same as yesterday, and for example with the normal evolution There has also been a change and improvement in the procedures for the administration of justice and its main social actors.
In any case, the goal has always been the same in this regard: to achieve justice.
Currently, in democratic societies, there is a power that is in charge of this aspect, the judicial power, which must be independent from the other two powers of the state: executive and legislative.
And this is so because it may be that it touches him manage justice at the request of the other two powers and that will demand their absolute independence in relation to the other two, that will be their guarantee.
The judiciary will administer justice by applying the laws and regulations in force, which were duly sanctioned by the legislative power.
The judges and the courts are the officials in whom this falls responsibility to administer justice in a compliant manner.
Meanwhile, it will be through a fair trial that it can be affirmed that justice was satisfactorily administered in a case, otherwise, we will unfortunately speak of injustice, something that also occurs in a common and regrettable way when judges do not enjoy independence mentioned.
Precisely that independence held by the judiciary will be a reliable indicator of the level of freedom that exists in a society.
In totalitarian or dictatorial regimes this does not exist by any means because the judiciary and the legislative power are co-opted by the executive.
